  1. Liquor Licence
    1. Purchases of alcohol products made through this website are made pursuant to our  General & Hotel Licence No. 57004047
    2. It is a requirement under the Liquor Licensing Act 1997 (SA) that you must provide your date of birth at the time of purchasing goods through our website. No person under 18 years of age is permitted to place an order for or be the recipient of any alcoholic goods.
  2.  Order
    1. An agreement exists between you and Booze Brothers once Booze Brothers receives and accepts an order from you.
    2. No obligation to sell or supply the goods will arise until the order is received and accepted by Booze Brothers.
    3. Each order may be accepted by Booze Brothers in its absolute discretion including, but not limited to, Booze Brothers accepting an order by imposing limits on the number of goods ordered by a customer and requiring payment of all outstanding amounts owed by a customer to Booze Brothers before accepting a further order of goods.
  3. Prices and Payment
    1. Unless specified otherwise, all prices on this website are in Australian dollars and expressed exclusive of GST. Prices may not include delivery charges and administration fees which may be charged separately.
    2. Payments for goods to be delivered must be made in full prior to delivery.
    3. We offer a range of options for payment of your account.  There may be fees, whether internal and/or external, associated with any of these methods of payment.  You must pay any and all such fees.  Credit card payments may incur a surcharge.
    4. All specials, promotions, clearances, competitions, offers and discounted items are as advertised on the website and are available only while stocks last or as otherwise advertised. All terms and conditions of these specials, promotions, clearances, competitions, offers and discounted items advertised on the website will apply.

  7. Delivery Policy
    1. Subject to you complying with these terms and conditions, we will deliver to the address specified in the delivery instructions.
    2. We reserve the right to charge a delivery fee.
    3. Please ensure that you or your nominated person (being 18 years of age or older) are present at the delivery address to sign for the goods. In accordance with the requirements under the Liquor Licensing Act 1997 (SA), the recipient must;
      1. provide proof that they are 18 (e.g. driver’s licence, passport or photographic identification card); and
      2. sign a declaration to that effect.
    4. You acknowledge that we (or our delivery agents) will keep a record of such declaration and evidence of age as per the requirements under the Liquor Licensing Act 1997.
    5. You may provide us with delivery instructions if no person is present to accept the deliver (such as leaving the liquor at the premises unattended). However, if you fail to provide those instructions and no person is present at the delivery address, the recipient is under 18 years of age or the recipient fails to provide satisfactory evidence of their age or a signed declaration as required above, Booze Brothers may refuse delivery of the goods. In these circumstances, the goods will be either be returned to Booze Brothers or an Australia Post Office for collection at your own cost.  A further delivery fee may be applicable to have your goods redelivered to your delivery address if necessary.
    6. Booze Brothers will endeavour to deliver within the times nominated and paid for by you at the time of your order (if any). You accept the risk that occasionally, due to circumstances which we have not foreseen, delivery times may be longer than times nominated and paid for by you.
    7. You agree that Booze Brothers shall not be liable for any delay in delivering your order if that delay or failure is caused by circumstances beyond our control.
  8. Cancellations
    1. Cancellation By Us
      1. We may cancel your order before delivery in whole or in part. We may do this even if we have received payment from you or sent you a tax invoice. Any such cancellation shall be by giving you such reasonable cancellation notice as we are able to provide via any of the contact details we have for you. The circumstances in which we may cancel your order are if:
        1. we are unable to deliver the goods due to circumstances outside of our control;
        2. any of the ordered goods are not available;
        3. there was any error in the description of any ordered goods or their price as advertised by us;
        4. your order is in breach of these or any other relevant terms and conditions or is contrary to a person’s rights or to any law; or
        5. these terms and conditions provide that we may not deliver your order.
    2. Cancellation by You
      1. You agree that you cannot change or cancel an order after it has been placed.

    1. Booze Brothers aims to include in the product list up to date pictures of all the goods. At times pictures are for illustrating purposes only and Booze Brothers does not warrant the accuracy of information contained on the product list and recommends that you read the labels on the goods carefully before consuming the goods.
  12. Intellectual Property Rights
    1. You acknowledge that any trademarks or logos which appear on the website are owned by or licensed to Booze Brothers or its related corporations and that you must not do anything to prejudice the rights of the trademark owner or licence to such trademarks or logos.
  13. Limitation of Liability
    1. This website is provided by Booze Brothers on an “as is” basis. Booze Brothers does not warrant or guarantee the accuracy or completeness of any information available on the website, that access to the website will be uninterrupted or error free, that any defects will be corrected immediately or that the website will be free from viruses or other contamination.
