1. Order
All orders are processed and distributed by The Clyde Pty Ltd Licence Number 50105630 trading as Booze Brothers ("Booze Brothers"). The reference to "orders" throughout these terms and conditions means an order by you to purchase goods from Booze Brothers. An Agreement exists between you and Booze Brothers once Booze Brothers receives and accepts an order from you. No obligation to sell or supply the goods will arise until the order is received and accepted by Booze Brothers. Each order may be accepted by Booze Brothers in its absolute discretion. No person under 18 shall place an order for any goods.
2. Prices and Payment
2.1. All prices on this website are in Australian dollars and include GST.
2.2. The full payment for your order and freight is deducted from your credit card on completion of your order and shipment will not commence until payment has been processed/validated.
2.3. We accept payment by Visa, Mastercard, Diners Club & American Express.
2.4. Credit card details are processed using SSL 256 bit encryption and are not stored by Booze Brothers.
2.5. We reserve the right to cease special offers or change prices at any time without notice.
2.6. Prices on this website will vary from Booze Brothers in-store prices.

4.2. During the checkout process you will be asked for your Card Security Code. This is a 3 digit code located either on or directly adjacent to the signature strip on the back of your credit card and is a security measure to protect against credit card fraud.
4.3. Booze Brothers is not liable for any loss of confidentiality or for any damages arising from your failure to comply with security measures.
4.4. Booze Brothers in no way guarantees the accuracy of information on external sites which can be accessed from links on this website. External links are provided for your convenience only.
4.5. It is the responsibility of members of our site to protect their log-in details from being disclosed to any third party.
5. Delivery Policy
5.1. Booze Brothers delivers to the address specified in the delivery instructions, Australia wide using Australia Post.
5.2. Please ensure someone is present at the delivery address to sign for the goods, if not, an Australia Post calling card will be left directing you to your nearest Post Office which will hold the parcel for you in accordance with Australia Post's own terms and conditions, unless you have given Booze Brothers alternative 'delivery instructions' e.g. leave on veranda.
5.3. Booze Brothers may use alternative couriers (to Australia Post) within Adelaide or as need dictates. If no one is present at the delivery address to sign accept delivery of the goods, a card may be left directing you to your nearest Booze Brothers store, unless you give us 'delivery instructions' e.g. leave on veranda.
5.4. Orders totalling over $200 will be delivered free of charge, otherwise you will be charged a delivery fee unless an offer has been labelled 'freight free'.
5.5. Anyone at the delivery address who receives the goods shall be presumed by Booze Brothers to be authorised to receive the goods on your behalf. Booze Brothers may request that the person who receives the goods at the delivery address provides satisfactory evidence of proof of age. Booze Brothers will refuse to deliver the goods if the person receiving the goods is unable or unwilling to provide evidence of proof of age. Any goods will not be delivered to persons under the age of 18 years old or who fail to provide proof of age satisfactory to Booze Brothers that the person is aged 18 years or over.
6. Returns
Booze Brothers guarantees what it sells but if you are not satisfied with the quality or condition of the goods you receive please contact us by email: enquiries@boozebros.com.au or by phoning us on (08) 8371 0177 for replacement or a full refund.
If there is no issue with the quality and condition of goods and you simply wish to return the item for a refund, Booze Brothers reserves the right to insist on the return of original items to its premises, at 353 Cross Roads, Clarence Gardens SA 5039, at the customer's expense before any refund can be processed.
7. Limitation of Liability
Booze Brothers warrants that the wines supplied will be of satisfactory quality and fit for their general purpose. However, you acknowledge and agree that all implied conditions and warranties on the part of Booze Brothers in relation to any ordered goods supplied by Booze Brothers are excluded to the maximum extent permitted by law. In respect of any liability which Booze Brothers cannot exclude, Booze Brothers' liability is limited, at its option, to the replacement or re-supply of the ordered goods, or a refund of the cost of the ordered goods.
8. Risk and Title
Risk and title in the goods passes to the customer upon delivery of the goods to the delivery address.
9. Out of Stock
Booze Brothers will use its best endeavours to ensure that all goods ordered by you are supplied to you. If the goods ordered are not readily available in stock whenever possible Booze Brothers will offer to you a comparable product of similar vintage and price.
10. Labelling of Goods
Booze Brothers aims to include in the product list up to date pictures of all the goods. At times pictures are for illustrating purposes only and Booze Brothers does not warrant the accuracy of information contained on the product list and recommends that you read the labels on the goods carefully before consuming the goods.
11. Licence and Intellectual Property Rights
11.1. You are licensed to use our website on your computer for your use in purchasing the goods from Booze Brothers.
11.2. You acknowledge that you are not permitted to make any other use of the Booze Brothers website unless given written prior authorisation by Booze Brothers.
11.3. You acknowledge that any trademarks or logos which appear on the Booze Brothers website are owned by or licensed to Booze Brothers or its related corporations and that you must not do anything to prejudice the rights of the trademark owner or licence to such trademarks or logos.
